Dear editor, I very much appreciated Rev. Peter Mikelics column regarding our Its Your Call program. It is good to let the wider church know we are serious about the recruitment of our rostered leaders (clergy and diaconal) and that they are a part of the process. John Mullen asks whether the candidate calls all the shots in the recruitment world of the 1990s Recruitment is in a paradoxical position at the moment. The economy is booming, unemployment rates are still falling but at the same time there is a perceived skills gap in a number of disciplines. Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

After seeing the picture on page 75 of the October 2005 issue, I beg the question, What on Earth were you thinking?! publishing such a spectacle for the world to see. The photo of target practice to end the life of a defenseless and otherwise benign beast sends all the wrong messages about guns and those who own and use them. I was particularly dismayed because it gives gun owners and users the reputation as senseless takers of life for no other reason but for target practice. Shame on the ones using their weapons this way!

Daimler-Benz yesterday decided not to let its German rivals leave it in the dust in super-luxury cars, approving plans to go ahead with production of a limousine to compete with Rolls-Royce. As Volkswagen and BMW reached a settlement on taking over Rolls brands, Daimlers management board gave the go-ahead for production of the Maybach, which it has previewed at auto shows for the past year. “With the positive decision for the production of the Mercedes- Benz Maybach, we are underscoring once more our claim to represent the absolute top in every market segment,” said Daimler chief executive Mr Jurgen Schrempp.

Anyway, suitably booted for our expedition round the magnificent Lac du Causse in the Couze Valley, we set off in high spirits as the sun had come out at last.

Kosher Vending Industries LLC and KRh Thermal Systems Inc. are testing new Kosher Vending machines in 25 locations throughout New Jersey and New York. The company is looking to place the Kosher Vending machines in airports, schools, hotels, casinos and hospitals.

H UNTING As a human activity, hunting is magnified in its significance by a deceptively simple feature: the evasiveness or resistance exhibited routinely by prey. Because of the behavioral challenges that it presents, hunting has had far-reaching consequences for key aspects of human social, psychological, and cultural life. Since the mid-1960s, for example, anthropologists have argued that hunting may have been a powerful and fundamental force shaping the very nature of cooperation and sharing among early humans.One such claim involves what the behavioral ecologist Bruce Winterhalder calls the risk reduction hypothesis. The failure rate of hunters is notoriously high. Even among experienced, highly skilled subsistence hunters who pursue big game animals, any one hunt is much more likely to result in failure than in success. Studying the Hadza of Tanzania in 1993, the anthropologist Kristen Hawkes reported that when hunting big game, Hadza men failed to make a kill 97 of every 100 days that they hunted. When a large game animal is killed, it often represents a windfall in excess of what any one hunter and his or her immediate family can consume. These circumstances promote reciprocity and sharing among hunters. By sharing the meat provided by a successful kill, a hunter effectively buys insurance against failure in future hunts. When, in the future, he or she fails to kill prey, other successful hunters with whom meat has been shared previously will reciprocate and provide meat to the unsuccessful hunter. The science writer Matt Ridley argues that the cooperation and reciprocity associated with hunting may help constitute the basis of systems of moral and ethical culture. In short, hunting is an activity that promotes cooperation and sharing because it entails the pursuit of a highly valued resource, access to which is unpredictable and risky.Anthropologists report that while both men and women hunt, in the vast majority of human societies this activity is predominantly male. Yet, it is not self-evident why males are more likely to hunt than females. Scholarly interpretations of the 1990s link hunting to sexual activity and rewards. While the matter is debated among social scientists, some researchers argue that males are motivated to hunt not only because of the food they acquire but because of the social esteem and increased sexual opportunities enjoyed by successful hunters.

A trip in a stretched limousine has rew- arded Fartown High School pupils. Six students were given the special trip for having a 100% attendance record in the school year and for improving behaviour. The students were driven from school to Scammonden Water, where they enjoyed games and a picnic. The initiative was org- anised by teacher Joanne Carter and project worker Sarah Clarke.

The management of persons with SCI is outlined clearly in the first four chapters. Chapter 1, Principles of SCI, reviews anatomy of the spinal cord and briefly mentions problems and goals of care phases of SCI. Chapter 2, Acute Care, covers neurologic and orthopedic aspects of SCI and treatment approaches to minimize further injury and complications. Chapter 3, Rehabilitation, classifies impairments of sensation, motor function, micturition, defecation, sexual function, autonomic function, skin, and breathing. The management of these impairments, with the goal of minimizing disability, is outlined. Problems that might be faced in continuing care, such as posttraumatic syringomyelia, spasticity, and pain, are focused on in Chapter 4. The fifth and last chapter of this book, Participatory Planning, emphasizes involving the patient in goal setting and presents approaches for the planning process. The authors intended audience-physicians working with patients with SCI (particularly residents in neurology and rehabilitation medicine), physical therapists, occupational therapists, nurses, and others seeking a basic introduction to SCI-certainly will find this work useful. Madison was intentionally set, Topeka Fire Department investigators said late Saturday. Personal Injuries follows The Laws of Our Fathers, which Turow completed in 1996. His latest novel is set in the fictional Kindle County, which has much of the atmosphere and many attributes of Chicago, the city in which Turow and his wife practice law. The IRS has located a bank account into which large amounts of money have been deposited by those associated with a small law firm. The account appears to be a device to hide income, and the IRS immediately puts the pressure on Robbie Feaver, one of the two partners in the firm. The real problem for Feaver began when the IRS agents opened his front door to let in U.S. Attorney Stan Sennett, who had an entirely different goal than tax recovery on his mind. That is when George Mason got involved. Mason was an attorney who had an office in the same building where Feavers firm had its offices. Mason becomes the voice of the novel as Feavers attorney for the defense of the tax fraud charges. The story is told largely from his point of view as he attempts to help Feaver through what becomes a complicated hodgepodge of personal relationships, schemes, double-dealing, subterfuge and, ultimately, death. It seems the U.S. Attorney is interested in leveraging the potential tax charges against Feaver to force Feavers cooperation in a sting operation. The target of the sting is Feavers law partners uncle, the chief judge of the local court. U.S. Attorney Sennett believes there is widespread corruption in the courts. Feaver confirms that he has been involved in a system by which he can influence the outcome of cases favorably. The system involves giving money to various people who work for different judges, and the belief is that some of the money in each case makes its way to the chief judge.
In his preface he relates that the present work is intended to offer a background set of principles and to review state-of-the-art techniques of diagnosis and treatment in SCI care. The management of persons with SCI is outlined clearly in the first four chapters. Chapter 1, Principles of SCI, reviews anatomy of the spinal cord and briefly mentions problems and goals of care phases of SCI. Chapter 2, Acute Care, covers neurologic and orthopedic aspects of SCI and treatment approaches to minimize further injury and complications. Chapter 3, Rehabilitation, classifies impairments of sensation, motor function, micturition, defecation, sexual function, autonomic function, skin, and breathing. The management of these impairments, with the goal of minimizing disability, is outlined. Problems that might be faced in continuing care, such as posttraumatic syringomyelia, spasticity, and pain, are focused on in Chapter 4. The fifth and last chapter of this book, Participatory Planning, emphasizes involving the patient in goal setting and presents approaches for the planning process. The authors intended audience-physicians working with patients with SCI (particularly residents in neurology and rehabilitation medicine), physical therapists, occupational therapists, nurses, and others seeking a basic introduction to SCI-certainly will find this work useful. They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

ALMOST ONE in four workers who featured in an undercover investigation into rogue tradesmen faces prosecution, it was revealed yesterday. The “cowboy” operators were exposed as they carried out work on a suburban terrace home containing seven hidden cameras planted by trading standards officers. The investigators rigged the house in Leatherhead, Surrey, with defects and watched from an adjacent room as tradesmen were called in.
Asda and Tesco could be set to go head-to-head again as both consider launching a network of tradesmen to cash in on consumers fears over cowboy workmen. The service would include a directory of maintenance services, such as plumbers and electricians, which would be guaranteed by the supermarkets, removing the worry of bad workmanship and rip-off merchants. Asda financial services director Gev Lynott told The Grocer that it had been looking at what such a service would entail, as one of the key problems for new homeowners was trying to find good tradesmen. It would be great if Asda could set up this sort of network. Wed need to make sure the people we used always did a good job, so it would be tricky But why not?

Why do we concern ourselves with such things? The concept of the contract allows people to make commitments between themselves that the state will enforce–the result being future stability of relationships, avoidance of conflict, and general societal harmony. How odd, then, to apply these concepts to family law! It might fairly be said that the whole of family law concerns itself with addressing members of society where relationships are no longer stable, where conflict abounds, and where harmony has ceased to exist. The concept of family, I think, arises only in the context of some directly stated or some implied commitment. A husband promises to share his life with his wife. Beyond the formal commitment of marriage, separate or same-sex couples can likewise expressly, or by implication, promise to share their lives with their partners. Parents promise to care for and support their children. Each of these commitments could be said to be some form of express or implied commitment between people.

At the heart of the changes are the amendments to the divorce law, and indeed from the moment we arrived and announced our common interest in family law from the course we had taught together at RIC for over a decade, the first question was what do you think of our new divorce law? How is the City Creek project impacting whats going on? WILMARTH: I think downtown has a lot of excitement right now. We saw a huge out-migration of tenancy during that time period when light rail and the interstate were being redone for the Olympics. But we see City Creek as being really the force to bring people back, both from a residential standpoint as well as an office standpoint. Now with the construction of 222 South Main, we are finally going to see some class A product thats going to accommodate some of these higher end corporate users that are looking to make a statement. 222 is really the office component of City Creek right now. City Creek is primarily residential and retail and someday probably will accommodate additional offices. This represents a great opportunity for our city to have a resurgence again.

I. INTRODUCTION This study empirically examines person-to-person transactions within the Internet market known as eBay. In this virtual market of unseen participants and products, buyers and sellers face the risks of repudiation, as the counter party may deny the agreement after the fact. Buyers assume risks associated with lack of seller integrity and asymmetric information about the particular product, as the buyer is typically required to send payment before the seller ships the product. In addition, for many eBay transactions, the cost of enforcing a contract is high relative to the transactions value, resulting in a practical absence of legal enforcement. (2) By providing a history of trade execution information, eBay benefits market participants by reducing information asymmetries while achieving substantial transaction cost economies. Market participants relate personal experiences, which eBay uses to calculate a numerical reputation measure for each user. Market participants, in turn, can use this reputation measure to assess counter party risk and adjust bidding behavior accordingly.

Spirns graceful writing style and sensitivity to the stories places can tell recalls Jonathan Stilgoes Common Landscapes in America, although Spins scope is international. Generously illustrated with her own photographs and landscape plans, Spirns poetic and sensual descriptions of places attempts to bring the reader into direct contact with the features of weather, topography, built environment and cultural values which together constitute the “language” of landscape. “Though human capacity for language may be innate,” Spirn writes, “we learn the language of landscape primarily through living in, building, caring for a place” (p. 193). The strength of this work is in the way Spiro draws upon so many examples, across time and in various places and cultures, to illustrate the ways that humans have interacted with their environments. Although Spirn tells cautionary tales of the mistakes people have made by not attending to the details of landscape, far more of her examples are of positive interactions: from the inner-city transformations of the Westminster Community Garden of the West Philadelphia Landscape Project to the sacred garden at Ryoanji, Japan. By emphasizing humans interactions with the world around them in architecture and garden design, Spirn implicitly rejects the dichotomy between nature and culture that has underpinned so much of western thought.

As portable basketball backstops have become commonplace at all of the pro arenas and a vast majority of college venues, its really no surprise that high schools across the country are opting for a similar main court feel. Plus, portable backstops give schools the flexibility to move the apparatus around and place it in different locations within the confines of a gym. We have seen a boom with portable backstops in the high school market, says Kevin Murphy, Vice President of Sports Construction and Team Sports for American Athletic, Inc. (AAI). So much so that weve centered some of our product development around the boom. Ten years ago, when I started with the company, we rarely sold a portable backstop to a high school. If we did, it was just as a shooting station for practice. Those high schools were built with ceiling-suspended backstops, one on each end for the main court and two on each sideline for practices.

The Bensonville (IL) Community Public Library is advertising “Learn to Use the Internet Through Librarys Free Tutorials” where the sessions “are one hour long and each session is limited to one or two people. No computer experience is necessary.” They will also teach the use of CLeaRNET, the community computing network. Thats just the tip of the iceberg, so to speak: there are many, many libraries which are finding out that many of their customers have to be trained in the use of computers, catalogs and databases before they can make full use of all our new resources. And never mind just “full use”! Just using a computerized catalog is beyond the experience and perhaps even the willingness of a lot of people. To say nothing of the fact that in the name of service we have loaded up these catalogs with access to all sorts of databases to add to the confusion. No wonder we have to run classes. Where do the staff come from to run all these classes, especially the one-on-one classes like the ones in Bensonville? Or the one-on-one the librarian on the floor has to give to the puzzled patron sitting dejectedly in front of the computer?

During the next two months, library users may notice the sights and sounds of light construction near the video and current magazine reading areas. This extra activity is temporary and will result in a computer lab that better meets the steady public demand for training in using the librarys computers and the Internet. All of that will soon change, thanks to financial support from the Woodruff Charitable Trust. The Woodruff Training Room will be created using high-quality floorto-ceiling glass demountable partitions with wood trim. The 18-foot by 28-foot room will house 16 computer workstations, an instructors workstation, and a large-screen projection unit. The wall system is manufactured by HI, a Wisconsin firm. The library will pay for electrical work, cabling, small furniture items, and two additional computers to supplement 15 laptop computers purchased previously. Dental surgeries, prisons and airports have one thing in common: people want to leave them as fast as possible. Jails and air terminals share a second characteristic: nobody wants one in their backyard. But this weekend two million Britons are flocking to underplanned and overcrowded airports in the first stage of their annual trek to a place in the sun. When the worlds first integrated airport was created in 1936, the journey from the centre of London to the centre of Paris took less time than the 21st-century jet-age journey via Gatwick or Heathrow, or on Eurostar. The key to speedy, seamless travel was a revolutionary new airport terminal just north of the village of Crawley. The Beehive, as the terminal at Gatwick racecourse soon became known, was a circular building with direct underground access from a specially built station astride the London-to- Brighton main line. Travellers could catch the 12.30pm from London Victoria, be airborne an hour later, arrive at Le Bourget airport in Paris just after 3.30pm local time and reach the Arc de Triomphe comfortably within three hours of leaving London. The stylish, spacious Art Deco design of the Beehive, and innovations such as telescopic covered walkways to the aircraft, made it a model for the great airport buildings of the future. Luton airport need not apply for inclusion in that particular list, because even with a pounds 100m facelift its carpet-warehouse appearance remains the antithesis of grace and the epitome of brutish utilitarianism. Consequently, the Bedfordshire airport is also a pretty grim place in which to while away a six-hour delay, with only the chance of a rant in front of the Airline docu-soap cameras - filming the everyday story of no-frills folk - to break the boredom. During a wrangle over funding the “improvements”, an easyJet insider told me that the airport operator was “building the Taj Mahal at Luton”. If only.
